BY-LAW NUMBER FOUR

MEETINGS OF THE ASSOCIATION

B.4.1. There shall be an Annual General and Annual Minor Meeting of the NOHA held on the first weekend in May.

B.4.2. That at the NOHA Annual Meetings a separate meeting will be held on the Friday night for Junior, Intermediate and Senior hockey items dealing solely with these categories.

B.4.3. Fourteen days notice of the meeting shall be given to all teams and clubs in good standing as well as the members of the Board of Directors.

B.4.4. The location of the Annual Meeting shall be determined each year by the Board of Directors.

B.4.5. At the Annual Meeting the order of business shall be as provided in B.4.11.

B.4.6. A Committee on Credentials shall be appointed by the President prior to each Annual General Meeting and Annual Minor Meeting.

B.4.7. At the Annual Meeting and at all Special General Meetings of the NOHA the following delegates shall be admitted with voting privileges, provided they represent a body in good standing with the NOHA:

All NOHA Senior, Intermediate and Junior teams - 1 delegate

All NOHA Minor Teams - 1 delegate

All Associations - 1 delegate

NOHA Board of Directors - 14 delegates

NOHA Director of Officials - 1 delegate

All NOHA Past Presidents - 1 delegate

All Life Members - 1 delegate

NOTE: These minor delegates may vote only on those matters which have an effect on Minor Hockey and the election of Council Directors and Officers.

Persons eligible to vote on behalf of Teams listed above will be that Team’s Manager(s), Coaches or Trainers registered in the Hockey Canada Registry with the named team that is listed on the delegate certificate or any person from the Teams Association Executive (as stated in the next paragraph).

The Associations Executive list used will be the one submitted to the NOHA Office with the Association membership. Notwithstanding the above, Association Presidents may appoint Executive members as needed by the Association and register them and their position with the NOHA by October 31st.  These appointees shall be entitled to vote, as association members, at the NOHA AGM.

No delegate shall be admitted to the Annual General Meeting unless he/she shall have filed with the Executive Director or their designate, a certificate as issued by the NOHA Office for a specific Team or Association of his/her appointment, signed by the Associations or Single Entry Teams Signing Officer of the team he/she represents, or if representing an Association must be represented by one of its members, and no delegate shall be allowed to represent more than one Team or Association at the same time, and in casting of ballots, no delegate shall cast more than his/her own ballot.

That a vote be allowed for each House League Association for a maximum of 6 votes, one vote per age division registered with the NOHA on House League matters only. (Initiation, Novice, Atom, Peewee, Bantam, Midget).

B.4.8. - Delete - May 2011

B.4.9. Notices of Resolutions and Nominations must be in the hands of the Executive Director four weeks prior to the Annual Meeting.

B.4.10. The facilities should be in place one year prior to the Annual meeting.  This is subject to the approval of the NOHA Executive.

B.4.11. The following are the regulations for government of the NOHA during the time of business, and the business shall be disposed of in the following order:

A) The reading of minutes of the last general meeting or any special meeting held during the year.

B) The President's address.

C) Receiving and reading the report of the Committee on Credentials.

D) Reading correspondence.

E) Reading the report of the Board of Directors.

F) Reading the Treasurer's Report (excluded from Minor Meeting).

G) Consideration of reports from the other committees which may have been appointed.

H) Motions of which notice has been given.

I) General business.

J) Election of officers (excluded from Minor Meeting).

B.4.12. The Annual Financial Report will be handed to all delegates as they enter the Annual Meeting.

B.4.13. No motion shall be received unless submitted in writing, with the names of the mover and seconder thereon, and said motions shall not be open for discussion until so stated by the presiding officer.

B.4.14. All motions shall be decided by a majority of votes cast.  In the case of a tie, the presiding officer shall have a second or casting vote, excepting amendment to Constitution as provided in Item 9 of the Constitution.

B.4.15. No delegate shall speak twice on the same subject without the permission of the chair, unless in explanation, or the mover in reply.

B.4.16. A delegate desiring to speak or submit a motion shall rise and remain standing and respectfully address the chair, and shall confine their remarks to the question, and shall not be interrupted unless upon a point of order.

B.4.17. Upon a point of order being raised while a delegate is speaking, or when called to order by the presiding officer, they shall at once take their seat, when the point of order shall then be stated by the delegate objecting. The presiding officer shall decide thereupon without debate and the delegate may then proceed. Enforced by the Chair.

Any ruling of the Chair may be appealed, once, by any voting delegate. This delegate will explain to all present the reason(s) for the appeal. The Chair will then have an opportunity to respond. A vote on the appeal will then be taken, and the result adhered to immediately.

B.4.18. No amendment to a motion shall be in order after an amendment to an amendment.

B.4.19. When a motion is under debate, no motion shall be entertained except to lay on the table, or amend, and these motions shall take precedence in the order of debate.

B.4.20. An amendment which entirely changes the subject of the original motion shall not be entertained as an amendment or substituted for the motion under debate.

B.4.21. No delegate, except one who has voted with the majority, shall be allowed to move for a reconsideration, and in this connection, the word majority shall apply to the vote by which the question was first decided.

B.4.22. After the motion has been stated by the presiding officer, it becomes the property of the NOHA, but may be withdrawn at any time previous to amendment unless objected to by a delegate.

B.4.23. There shall be no debate upon any question after it has been put by the presiding officer.

B.4.24. When a vote is called, it may be taken by each delegate holding up his right hand, or may be taken by ballot, at the discretion of the presiding officer.

B.4.25. Any person who has been properly nominated and wishes to be elected to the Board of Directors, Vice-President or President of the Northern Ontario Hockey Association, but cannot attend the Annual Meeting due to prior commitments must submit a letter to the NOHA Executive Director before the Annual Meeting explaining the reason(s) for their absence. NOTE: Other unforseen circumstances will be considered legitimate - ie - accident, sickness or death in the family.

B.4.26. The NOHA Annual General Meeting shall be rotated annually, unless application to host is received by another centre and the applying centre is not in the same district as the previous years host centre, as follows: Sudbury, Sault Ste. Marie, North Bay, and Timmins. Once the rotation is complete it shall recommence at the start of the cycle.
