REGULATION NUMBER SIX

RELEASES

R.6.1. The final date for releasing all minor players shall be January 10th in any playing season.  All releases must be entered in the HCR by Midnight on January 10th

R.6.2. That the NOHA Permission to Skate form will only be an automatic release when the team receives the signature of either one of the signing officers so named on the team application form of the team or club which the player is a member.  Forms must be attached to the player’s record in the HCR. 

R.6.3. A player shall cease to be a member of a club under the following circumstances:

A) When the player has not been registered as a member of any club in the NOHA, HC branches or the IIHF for a full playing season or more.

B) When a player is released by the club, such release being in writing executed by the President and Secretary of the club.

C) When the player is not over 18 years of age and resides with their parents or guardian, and the parents or guardian change their place of residence and player then continues to reside with their parents or guardian.

NOTE: A guardian as referred to in these regulations shall mean a person with whom the player has actually resided from January 1st preceding the change in residence.

D) When a player has graduated from a recognized university or college, at the conclusion of the term just past. It should be noted that this provision only applies to a player graduating, not merely changing from one college to another, except any student who is required to leave his/her present university or college in order to complete his/her professional training and in which case he/she must procure affidavits from his/her former university or college.

E) When a player is a bona fide student, above Junior age, in attendance at any university or college, provided he/she has been in residence at such institution, or in residence in the area wherein the university or college is situated, by January 10th; and further provided he/ she is not moving, without graduating; from another recognized university or college.

F) A Junior, Juvenile, or Midget age registered player, attending a recognized university or college, having failed to meet the academic standard at such university or college at midterm or the end of the semester in the current season, be granted a release by the NOHA Board of Directors on the basis of a written appeal substantiated by affidavits from the said university or college. The player must be registered by February 10th and only with the last team or club with whom he/she was registered prior to registering at the above university or college.

G) When the player is a member of any branch of the permanent military forces or the Royal Canadian Mounted Police.

H) When the player is a full-time employee since May 1st of the current year, or has entered employment at the end of the scholastic year, and is moved by his/her employer and continues in their employ.

I) When the player becomes overage for the division in which he/she last played; and there is, in the community in which he/she resides or last played, no team in the higher division in which he/she is then qualified.

R.6.4. In Minor hockey, where a player has signed with a club's affiliated higher division or category team and the higher team wishes to transfer the said player to the lower division or category team, provided that the player is of age for that division or category, that this be allowed provided the player has not played after January 10th in the same season.

R.6.5. Players released by Senior A or Junior teams may only be signed and registered by another team if such team has not 21 (Senior) or 21 (Junior) players already registered as of January 10th. Players may not be released by a team to enable it to replace such players.

R.6.6. Players referred to in Release of Membership Items R.6.3.A) to I) shall not be required to comply with the residence date of November 1st, but must establish residence before being allowed to register and shall maintain such residence to remain eligible.

R.6.7. A player resident in a community represented by a club with a team entered in a series for which the player is eligible to play, must register with that club except where such player's services are waived by such club, in which case the player may play for any club for which the player is eligible to play. Such waiver must accompany the application for the player's certificate. A player who is released, is only released for that age division. At the end of the division he must return home or be released again. To return to his habitual residence after his minor year a player requires a release from the current team. It must not be construed as having altered the original residence of the player and it shall be filed with the Executive Director of the NOHA.

R.6.8. A player released from any Senior A or Junior team before January 10th, in the current season, may register and play with any team in the same or lower category, Senior or Junior, for which the player is eligible within the NOHA.

R.6.9. Players dropped by teams under Items R.4.19 and R.4.20. are released and may register with a new team up until February 10th, provided such new team does not have 21 players - Junior, or 21 players - Senior, already registered by January 10th.

After January 10th, no team shall be able to release any of its players and replace the players released by any other new players whether such new players were Free Agents, or players released by other teams or otherwise.

An import, if dropped, if he/she so desires, may return to the branch from which he/she was transferred, where he/she will be eligible to play under the conditions as outlined above, without being considered an import; but if he/she plays in any other branch, will be so considered. A player must be signed by his/her new club before the final registration date. This regulation shall also apply to players released by clubs in the International Ice Hockey Federation and USA Hockey up to January 1st.

Any player considered an import under these regulations may be released as aforesaid and replaced by another import, so long as the club does not exceed the total number of registered players permitted.

R.6.10. A Juvenile aged player, in order to register in a category higher than Juvenile outside of the municipality shall be required to obtain a release signed by the President of the Junior team if operative, and the President of the Juvenile team if operative in that municipality.

If there is more than one team in either the Juvenile or Junior category, then the release must be obtained from the higher category team which is a member of the player's last club.

R.6.11 Regulation Removed May 2006.

R.6.12 No association shall charge an administration fee for releases.  Any Association that does so will be suspended by the NOHA Board.
