REGULATION NUMBER EIGHT

SUSPENSIONS

R.8.1. Any team or club, or the executive thereof, in any division, sub-division, or category, failing to abide by the NOHA Constitution or the rulings and decisions of the NOHA Board of Directors shall be suspended, and no playing cards of franchise shall be granted for the ensuing year.

R.8.2. Any suspension by the President of the NOHA involving special violations, shall have the right of appeal.

R.8.3. Prior to the commencement of each hockey season, the Chairman of the Referee's Committee, under the authority of the Board of Directors of the NOHA, shall issue to all members, the Ontario Hockey Federation Minimum Suspension list for all infractions and misconduct penalties which result in Player, Manager or Coaches suspensions.

R.8.4. Any player who receives any of the penalties outlined on the Chairman's Suspension List, will be required to sit out the minimum number of games outlined for the infraction. However, the President reserves the right to separately investigate any incident and deal with such on its separate merit.

R.8.5. It is the responsibility of each team to record on the score sheet and monitor its own suspensions and to sit out any player or team personnel as required by the NOHA's suspension policies.

Any player receiving a suspension above the minimum, as listed on the OHF Minimum  Suspension List, will serve the additional games once formal notification has been received by the team. This will also include any suspension code not listed on the OHF Minimum Suspension List.

R.8.6. A coach suspended by the NOHA will not be permitted to direct the team during a game for the duration of the suspension. A suspended manager, coach or playing coach must not be in or about the dressing room, before, during or after any game, nor between periods of any game during his/her suspension, nor be seated in the arena in a position to direct his/her team. The penalty for violation of this rule shall be an additional two games suspension for each game in which an infraction occurs. A playing coach suspended for an action as a player loses his/her right as a player and coach.

R.8.7.

D) In minor hockey, at a sanctioned HC/OHF/NOHA tournament, any coach, manager, trainer, team official, or player receiving a game misconduct, gross misconduct, or match penalty, is subject to the disciplinary regulations of the individual tournament for the balance of that tournament.  In addition, the said person will serve any unfinished portion of his/her suspension in his/her next game or games, regardless if they be league, scheduled exhibition, league play-off, or NOHA play-off games, and regardless of the order in which they occur.

E) In all divisions, sub-divisions, and categories of HC/OHF/NOHA hockey, approved exhibition and tournament games missed by a team official or player will count in serving suspensions for game misconducts, gross misconducts, and match penalties provided:

i) the penalty was not for physical abuse of an official

ii) the exhibition game was approved by the NOHA Council Director twenty four (24) hours in advance of the scheduled game time (see R.1.19)

Exhibition games scheduled with 5 or less games remaining in the regular league season shall not be counted as games served by player(s) and/or team offical(s) under suspension.  Suspension games shall only be counted as served during regular and playoff games.

iii) in the case of tournament games, the team was approved for the tournament before the penalty was assessed.

F) Any affiliated player upon being suspended in a game, when playing in a higher division/category of hockey, must serve his/her suspension in the division/category in which he/she is registered.  The full suspension must be served with the lower (registered) team before playing for the affiliated (higher) team.  If the lower division/category team is out of competition for the current season, then his/her suspension must be served with the higher division/category team. 

NOTE:  Teams failing to enforce these automatic suspensions leave the suspended player or team official and team officers liable for further disciplinary action and possible forfeiture of games involving the suspended person(s). 

In the event such suspensions cannot be served in league play, previously approved exhibition play, league play-offs, or NOHA play-offs, due to team elimination, such suspension would be carried forward to the next season in league or scheduled exhibition games.

R.8.8. Any player penalized for physical abuse of an official in addition to the suspension issued will be required to appear before the NOHA Board of Directors.

R.8.9.   During NOHA Junior play-offs, in lieu of sitting out a player for the game suspensions outlined on the OHF Minimum Suspension List for game infractions, a team may pay a fine penalty to the NOHA, in the amount of $50.00 for each FULL game of the suspension.  The President reserves the right to limit any team or player to the number of fine penalties which can be paid to the NOHA during any given play-off series.  If the team decides to pay the fine, the full suspension must be purchased prior to the team’s next game. The NOHA Office must be notified, indicating payment prior to playing player.  This must be done by fax or phone to the NOHA office and NOJHA Office prior to the player playing.

R.8.10. If a team is withdrawn from the ice or fails to go on the ice and start play, or, being on the ice, fails to start play within two (2) minutes when ordered to do so by either referee (if the two referee system is being used) or by the referee-in-charge (if a referee and two linesmen system is being employed), the game shall be forfeited to the opposing team. The club official acting as Coach as reported by the game Referee but not necessarily the game sheet signor may be automatically suspended for one (1) year from the infraction.  The club official acting as the Coach will be suspended immediately pending a disciplinary hearing.

R.8.11. If a team is withdrawn or fails to go on the ice, or, being on the ice, fails to start play a second time within the same game, when ordered to do so by either referee (if the two-referee system is being used) or by the referee-in-charge (if a referee and two linesmen system is being employed), the two (2) minute allowance shall not be granted. The game referee shall immediately declare the game forfeited to the non-offending team with the game points awarded to it. The same penalty may apply to the players or officials responsible for this as in Item R.8.10.

R.8.12. If a team fails to present itself at the time and place appointed to play any game, unless such failure is caused by an unavoidable accident or an unforseen contingency, the game and/or series shall be awarded to the opposing team and the same penalty may apply against the team or club officials or players responsible for this action as in Item R.8.10.

R.8.13. If the NOHA suspends a player, team official, or a game official for longer than 30 days then the person who is suspended shall be given a hearing within 15 days of the suspension being issued.
